Trade name
A trade name identifies a business in commerce and, in Switzerland, overlaps with company-name, trademark and unfair-competition protection.
A trade name is the name under which an enterprise appears in the market. In Switzerland, protection may arise from the registered company name in the commercial register, from trademark registration, and from rules against misleading or confusing conduct. The scope depends on distinctiveness, priority, geographic use and the goods or services concerned. A trade name does not automatically give broader trademark rights, and clearance should consider existing companies, marks, domain names and sector-specific naming rules.
