Transfer of undertaking
A transfer of undertaking moves a business or business unit to a new employer, often carrying employment relationships with it.
In Switzerland, when a business or part of a business is transferred to another owner, employment relationships generally pass to the acquirer with existing rights and obligations. Employees must be informed, and in certain situations consulted, especially if measures affecting them are planned. An employee may object to the transfer, which leads to termination after the applicable notice period. Collective agreements and liability for claims require careful assessment in transactions, restructurings, and outsourcing.
