Warranty rights

Warranty rights protect buyers when goods or services fail to meet agreed, promised, or legally expected quality standards.

In Switzerland, warranty rights in sales law concern defects existing at transfer of risk and allow the buyer, depending on the case, to rescind the contract, request a price reduction, or claim damages. Contractual guarantees may add promises by the seller or manufacturer but cannot always replace mandatory consumer protections in regulated contexts. Notice periods, limitation periods, and the distinction between statutory warranty, commercial guarantee, and product liability are crucial. Comparative systems often provide repair or replacement as primary remedies.
