Workplace discrimination

Workplace discrimination is unequal treatment at work based on protected characteristics rather than legitimate job-related reasons.

Swiss law protects employees against certain forms of discrimination, especially sex-based discrimination including pregnancy, family status, sexual harassment, pay inequality, and unequal hiring or dismissal. Constitutional equality principles, the Gender Equality Act, disability rules, data protection, and general personality protection may be relevant depending on the case. Other grounds, such as race, religion, age, sexual orientation, or nationality, can be addressed through specific norms or general abusive-termination and personality-rights principles. Employers must prevent discriminatory practices and provide a safe, respectful workplace.
