Wrongful termination

Wrongful termination refers to an unlawful or abusive dismissal that may trigger compensation, reinstatement, or other remedies.

In Swiss private employment law, the closer concept is often abusive termination or termination at an unlawful time. A dismissal may be abusive if motivated by prohibited reasons, retaliation, exercise of constitutional or contractual rights, or bad-faith conduct. Termination during protected periods, such as certain illness, accident, pregnancy, or service situations, may be invalid or postponed.
