The Federal Department of Economic Affairs, Education and Research (EAER) may in the following cases authorise by means of an ordinance a temporary suspension of individual provisions of the product specification that are set out in Article 7 paragraph 1 letters c and d:
- in the case of extraordinary natural events that prevent compliance with specific points of the product specification for a specific period;
- in response to official decisions based on federal or canton law, in particular relating to public or plant health, that prevent compliance with specific points of the product specification for a specific period.
The group shall apply to FOAG for a temporary suspension. The application must be accompanied by proof that the application has been approved by the representatives’ meeting of the group.
The group must prove that temporary suspension will have no direct effects on the principal physical, chemical, microbiological and organoleptic properties of the products or on its specific shape.
It must prove that appropriate measures are being taken to inform the public or the end consumers of the temporary suspension of the provisions.
The EAER may stipulate additional terms and conditions for the temporary suspension of provisions. In particular, it may restrict the suspension to part of the geographical area.
The temporary suspension may not last for more than one year; it may only be extended on the same grounds on one occasion .
