Accordo agricolo tra la Svizzera e gli Stati membri del CCG

Concluso il 22 giugno 2009 Approvato dall’Assemblea federale il 2 marzo 20102 Entrato in vigore il 1° luglio 2014

Art. 1 1. Il presente Accordo concernente lo scambio di prodotti agricoli (qui di seguito denominato «il presente Accordo») tra la Confederazione Svizzera (qui di seguito denominata «la Svizzera») e i Governi degli Emirati Arabi Uniti, il Regno del Bahrain, il Regno dell’Arabia Saudita, il Sultanato dell’Oman, lo Stato del Qatar e lo Stato del Kuwait (qui di seguito denominati «il CCG»), qui di seguito denominati congiuntamente «le Parti», è concluso facendo seguito all’Accordo di libero scambio tra gli Stati membri del CCG e gli Stati dell’AELS (qui di seguito denominato «l’Accordo di libero scambio»), sottoscritto il 22 giugno 20093, e, in particolare, in conformità all'articolo 2.1 di tale Accordo. 2. Il presente Accordo si applica anche al Principato del Liechtenstein fino a quando il Trattato di unione doganale concluso il 29 marzo 19234 tra la Svizzera e il Princi- pato del Liechtenstein rimane in vigore.

Art. 2 Il CCG accorda concessioni tariffarie per prodotti agricoli originari della Svizzera, come specificato nell’allegato I del presente Accordo. La Svizzera accorda conces- sioni tariffarie per prodotti agricoli originari del CCG, come specificato nell’allegato II del presente Accordo.

Art. 3 1. Le regole in materia di origine e le disposizioni sulla cooperazione in questioni doganali disciplinate nell’allegato IV dell’Accordo di libero scambio si applicano al presente Accordo, fatte salve le disposizioni di cui al paragrafo 2. In tale allegato, ogni riferimento agli «Stati dell’AELS» va inteso come riferimento alla Svizzera. 2. Ai fini del presente Accordo, l’articolo 3 dell’allegato IV dell’Accordo di libero scambio si applica, mutatis mutandis, alla Svizzera e al CCG.

Art. 4 Le parti esaminano qualsiasi difficoltà che può insorgere nei loro scambi di prodotti agricoli e si sforzano di trovare soluzioni adeguate.

Art. 5 Le Parti si impegnano a promuovere, nel quadro delle rispettive politiche agricole, una progressiva liberalizzazione del loro commercio di prodotti agricoli.

Art. 6 Salvo disposizioni contrarie nel presente Accordo, le Parti confermano i loro diritti e i loro obblighi derivanti dall’Accordo sull'agricoltura dell’OMC5.

Art. 7 1. I diritti e gli obblighi delle Parti in merito alle misure sanitarie e fitosanitarie sono disciplinati dall’Accordo sull’applicazione di misure sanitarie e fitosanitarie dell’OMC 6 (qui di seguito denominato «Accordo SPS»). 2. La Svizzera e il CCG si scambiano i nomi e gli indirizzi degli organi di contatto per le perizie sanitarie e fitosanitarie al fine di facilitare le consultazioni tecniche e lo scambio di informazioni. 3. Fatto salvo il paragrafo 1, le Parti convengono di tenere consultazioni nel quadro del Comitato misto se una di esse ritiene che un’altra Parte abbia adottato misure che potrebbero creare o che abbiano creato un ostacolo al commercio, al fine di trovare una soluzione adeguata in conformità all’Accordo SPS.

Art. 8 Il presente Accordo entra in vigore o viene applicato provvisoriamente alla stessa data in cui entra in vigore o viene applicato provvisoriamente l'Accordo di libero scambio tra la Svizzera e il CCG. Il presente Accordo rimane in vigore fino a quan- do le Parti contraenti rimangono Parti all’Accordo di libero scambio.

In fede di che, i sottoscritti, debitamente autorizzati a tale scopo, hanno firmato il presente Accordo.

Fatto a Hamar, il 22 giugno 2009, che corrisponde al 29 jumada II dell’anno isla- mico 1430, in due esemplari originali in lingua inglese.

Condizioni applicabili all’importazione nel CCG di prodotti originari della Svizzera

I prodotti originari della Svizzera contemplati dal presente allegato godono di con- cessioni del CCG secondo la categoria a cui appartengono:

1. categoria A: al momento dell’entrata in vigore del presente Accordo il CCG

abolisce i dazi doganali all’importazione dei prodotti elencati in questa categoria;

2. categoria B: cinque anni dopo l’entrata in vigore del presente Accordo il

CCG abolisce i dazi doganali all’importazione dei prodotti elencati in questa categoria;

3. categoria C: si continua a parcepire i dazi doganali sui prodotti di questa

categoria. Il CCG informa la Svizzera di ogni modifica di aliquota applicata alla nazione più favorita:

4. categoria X: i prodotti di questa categoria sono esclusi dal campo d’appli-

cazione del presente Accordo; 5. categoria P: i prodotti di questa categoria sono colpiti dal divieto d’impor- tazione nel CCG.
