Ordonnance instituant des mesures à l’encontre de la République islamique d’Iran
Modification du 23 avril 2008
Le Conseil fédéral suisse arrête:
I L’ordonnance du 14 février 2007 instituant des mesures à l’encontre de la Répu- blique islamique d’Iran1 est modifiée comme suit:
Préambule vu l’art. 2 de la loi du 22 mars 2002 sur les embargos (LEmb)2, en exécution des résolutions 1737 (2006), 1747 (2007) et 1803 (2008)3 du Conseil de sécurité des Nations Unies,
Art. 1a Interdiction d’acquérir des biens d’équipement militaires et du matériel connexe L’acquisition, l’importation, le transit et le courtage en provenance de la République islamique d’Iran de biens d’équipement militaires de toute sorte, y compris d’armes et de munitions, de véhicules et d’équipement militaires, de matériels paramilitaires, de même que leurs accessoires et pièces de rechange, sont interdits.
Art. 3a Interdiction de satisfaire certaines créances 1 Il est interdit de satisfaire les créances des personnes physiques, entreprises et entités suivantes lorsque ces créances se fondent sur un contrat ou une affaire dont l’exécution a été empêchée ou affectée directement ou indirectement par des mesu- res imposées par le Conseil de sécurité des Nations Unies dans le cadre des résolu- tions 1737 (2006), 1747 (2007) ou 1803 (2008): a. le gouvernement de la République islamique d’Iran; b. les personnes physiques, entreprises et organisations en République islami- que d’Iran; c. les personnes physiques, entreprises et organisations citées aux annexes 3 et 4;

d. les personnes physiques, entreprises et organisations agissant selon les ins- tructions ou pour le compte des personnes physiques, entreprises et organisa- tions visées aux let. a à c.
Art. 3b Interdiction d’entrée en Suisse et de transit par la Suisse 1 L’entrée en Suisse et le transit par la Suisse sont interdits aux personnes physiques citées à l’annexe 4.
2 L’Office fédéral des migrations (ODM) peut accorder des dérogations en confor-
mité avec les décisions du comité compétent du Conseil de sécurité des Nations Unies.
Art. 4 al. 1, 1bis et 3 1 Le SECO surveille l’exécution des mesures de coercition prévues aux art. 1, 1a, 2 et 3a. En conformité avec les résolutions 1737 (2006) et 1803 (2008), il notifie au Comité compétent du Conseil de sécurité de l’ONU et à l’Agence internationale de l’énergie atomique la fourniture des biens, y compris les technologies et les logi- ciels. 1bis L’ODM surveille l’exécution de l’interdiction d’entrée et de transit prévue à l’art. 3b. 3 L’ODM édicte, à l’attention des organes de contrôle à la frontière, représentations à l’étranger et autres services à l’étranger habilités à délivrer des visas, les directives nécessaires à l’exécution de l’al. 2.
Art. 6 al. 1 1 Quiconque viole les dispositions des art. 1, 1a, 2, 3a et 3b est puni conformément à l’art. 9 LEmb.
II Les annexes 1 et 3 sont remplacées par les versions ci-jointes.
III L’ordonnance est complétée par l’annexe 4 ci-jointe.

IV La présente modification entre en vigueur le 24 avril 20084.

Biens, y compris les technologies et les logiciels, visés par les interdictions prévues à l’art. 1, al. 1
1. Les biens cités à l’annexe 2, partie 1, OCB5. Sont exclus les biens portant le numéro de liste 0A001 pour autant qu’ils soient exclusivement destinés à des réacteurs à eau légère.
2. Les matières nucléaires citées à l’art. 1 de l’ordonnance du 10 décembre
2004 sur l’énergie nucléaire (OENu)6. Est exclu l’uranium faiblement enri-
chi incorporé à des assemblages d’éléments combustibles destinés à des réacteurs à eau légère.
3. Les systèmes complets de fusées et de véhicules aériens sans pilote, y com-
pris leurs sous-systèmes complets. 4. Les biens cités à l’annexe 2, partie 2, OCB avec numéros de liste portant les codes du régime de contrôle 101 à 199. 5. Les biens cités à l’annexe 2, partie 2, OCB avec numéros de liste portant les codes du régime de contrôle 201 à 299. Sont exclus les biens pour autant qu’ils soient exclusivement destinés à des réacteurs à eau légère ou nécessai- res à la coopération technique fournie à la République islamique d’Iran par l’Agence internationale de l’énergie atomique. 6. Tous les autres biens pouvant être utilisés en relation avec des systèmes de fusées et de véhicules aériens sans pilote visés au point 3 et qui sont cités à l’annexe 2, partie 2, OCB, à l’annexe 3 OCB ou à l’annexe 1 de l’ordon- nance du 25 février 1998 sur le matériel de guerre (OMG)7.
