L'IRS a participé aux négociations avec le Department of Justice. Selon une vision commune, la "closure" découlant du programme s'applique également à l'IRS. Cela est également précisé comme suit dans la déclaration du 29 août 2013 de l'"acting commissioner" Daniel Werfel: "On behalf of the IRS, I extend my appreciation to both the Justice Department and the Swiss government for developing a way forward that provides the United States with information that will be critical to the enforcement of our tax laws and will bring closure for Swiss banks that meet the requirements of the program."

Le Conseil fédéral n'a aucune raison de douter du respect de cette garantie politique.

La Securities and Exchange Commission (SEC) n'a, en revanche, pas participé aux négociations. Les questions de surveillance ainsi que d'autres délits non fiscaux n'ont pas été abordées durant les discussions.
