Ordonnance instituant des mesures à l’encontre du Liberia
du 27 juin 2001 (Etat le 22 juillet 2003)
Le Conseil fédéral suisse, vu l’art.2 de la loi fédérale du 22 mars 2002 sur l’application de sanctions internationales (loi sur les embargos)1,2 arrête:
Art. 1 Interdiction de fournir de l’équipement militaire et des biens similaires
La fourniture, la vente et le courtage à destination du Liberia d’armements de toute sorte, y compris d’armes et de munitions, de véhicules et d’équipement militaires, de matériels paramilitaires, de même que leurs accessoires et pièces de rechange, sont interdits.
La livraison de matériel militaire non létal destiné uniquement à des fins humanitaires et de protection, ainsi que l’exportation de vêtements de protection (p. ex. gilets pare-balles) par le personnel des Nations Unies, les représentants des médias et les agents humanitaires pour leur usage personnel, peuvent être autorisés à titre exceptionnel par le Secrétariat d’Etat à l’économie (seco) après consultation du Département fédéral des affaires étrangères.
La fourniture, la vente et le courtage de conseils techniques et de moyens d’assistance ou d’entraînement liés à la fourniture, la production, l’entretien et l’utilisation des biens décrits à l’al.1 sont interdits.
Les al. 1 et 3 ne s’appliquent que dans la mesure où la loi du 13 décembre 1996 sur le contrôle des biens3, la loi fédérale du 13 décembre 1996 sur le matériel de guerre4 ainsi que leurs ordonnances d’application ne sont pas applicables.
Art. 2 Diamants bruts
L’importation, le transit, la mise en entrepôts douaniers et la sortie d’entrepôts douaniers de diamants bruts provenant directement ou indirectement du Liberia, indépendamment de leur pays d’origine, sont interdits.
Art. 2a5 Bois rond et bois d’œuvre
L’importation de bois rond et de bois d’œuvre originaires du Liberia est interdite.
L’interdiction s’applique aux marchandises des numéros 4401 à 4421; 4701 à 4705; 9401.6100; 9401.6900; 9403.3000 à 9403.6000 et 9406.0010 du tarif des douanes6.
Art. 3 Entrée en Suisse et transit
L’entrée en Suisse et le transit par la Suisse sont interdits:
aux membres de haut rang du gouvernement et des forces armées du Liberia ainsi qu’à leurs conjoints;
aux personnes fournissant un soutien financier ou militaire aux groupes de rebelles armés des pays voisins du Liberia.
Les personnes visées à l’al.1 sont mentionnées à l’annexe.
L’Office fédéral de l’immigration, de l’intégration et de l’émigration (IMES)7 peut, en conformité avec les décisions du Conseil de sécurité des Nations Unies ou pour la protection d’intérêts suisses, accorder des dérogations.
Art. 3a8 Contrôles
Le seco procède aux contrôles.
Le contrôle à la frontière incombe à l’Administration fédérale des douanes.
Art. 49 Dispositions pénales
Quiconque aura violé les dispositions des art. 1 à3 sera puni conformément à l’art.9 de la loi sur les embargos.
La désignation de l’unité administrative a été adaptée selon l’art. 4a de l’O du 15 juin 1998 sur les publications officielles (RS 170.512.1).
Le seco est chargé de la poursuite et du jugement des infractions au sens des art. 9 et 10 de la loi sur les embargos; il peut ordonner des saisies ou des confiscations.
Les art. 11 et 14, al. 2, de la loi sur les embargos sont réservés.

La présente ordonnance entre en vigueur le 28 juin 2001.
