Verordnung über Massnahmen gegenüber der Islamischen Republik Iran
vom 14. Februar 2007 (Stand am 23. Juni 2010)
Der Schweizerische Bundesrat, gestützt auf Artikel 2 des Embargogesetzes vom 22. März 20021 (EmbG), in Ausführung der Resolutionen 1737 (2006), 1747 (2007) und 1803 (2008)2 des Sicherheitsrates der Vereinten Nationen,3 verordnet:
1. Abschnitt Zwangsmassnahmen
Art. 1 Verbot der Lieferung und der Beschaffung von Gütern im Bereich Kernwaffen und Trägersysteme
Die Lieferung, der Verkauf und die Durchfuhr von Gütern, einschliesslich Technologien und Software, nach Anhang 1 nach der Islamischen Republik Iran sind verboten.
Die Beschaffung von Gütern, einschliesslich Technologien und Software, nach Anhang 2 aus der Islamischen Republik Iran ist verboten.
Die Erbringung von Dienstleistungen aller Art, einschliesslich Finanzdienstleistungen, Vermittlungsdienste und technische Beratung, die Gewährung von Finanzmitteln und die Tätigung von Investitionen im Zusammenhang mit der Lieferung, dem Verkauf, der Durchfuhr, der Herstellung oder der Verwendung von Gütern nach Absatz 1 sind verboten.
Das Verbot nach Absatz 3 gilt auch im Zusammenhang mit sonstigen Gütern, die ganz oder teilweise für die Aktivitäten der Islamischen Republik Iran im Bereich der Anreicherung von Uran, der Wiederaufarbeitung von Kernbrennstoffen, des Schweren Wassers oder der Entwicklung von Trägersystemen für Kernwaffen bestimmt sind oder bestimmt sein könnten.
Das Staatssekretariat für Wirtschaft (SECO) kann im Verfahren nach Artikel 16 der Güterkontrollverordnung vom 25. Juni 19974 (GKV) sowie in Übereinstimmung mit den Beschlüssen des zuständigen Komitees des UNO-Sicherheitsrates Ausnahmen von den Verboten der Absätze1, 3 und 4 gewähren.

Vorbehalten bleiben die Bestimmungen des Güterkontrollgesetzes vom13. Dezember 19965 und des Kriegsmaterialgesetzes vom13. Dezember 19966.
Art. 1a7 Verbot der Beschaffung von Rüstungsgütern und verwandtem Material
Die Beschaffung, die Einfuhr, die Durchfuhr und die Vermittlung von Rüstungsgütern jeder Art, einschliesslich Waffen und Munition, Militärfahrzeuge und -ausrüstung, paramilitärische Ausrüstung sowie Zubehör und Ersatzteile dafür, aus der Islamischen Republik Iran sind verboten.
Art. 2 Sperrung von Geldern und wirtschaftlichen Ressourcen
Gelder und wirtschaftliche Ressourcen, die sich im Eigentum oder unter der Kontrolle der natürlichen Personen, Unternehmen und Organisationen nach Anhang 3 befinden, sind gesperrt.
Es ist verboten, den von der Sperrung betroffenen natürlichen Personen, Unternehmen und Organisationen Gelder zu überweisen oder Gelder und wirtschaftliche Ressourcen sonst wie direkt oder indirekt zur Verfügung zu stellen.
Ausnahmsweise kann das SECO nach Rücksprache mit den zuständigen Stellen des Eidgenössischen Departements für auswärtige Angelegenheiten (EDA) und des Eidgenössischen Finanzdepartements sowie nach Meldung an das zuständige Komitee des UNO-Sicherheitsrates, in Übereinstimmung mit den Beschlüssen dieses Komitees oder zur Wahrung schweizerischer Interessen Zahlungen aus gesperrten Konten, Übertragungen gesperrter Vermögenswerte sowie die Freigabe gesperrter wirtschaftlicher Ressourcen bewilligen.
Art. 3 Begriffsbestimmungen
In dieser Verordnung bedeuten:
Gelder: finanzielle Vermögenswerte, einschliesslich Bargeld, Schecks, Geldforderungen, Wechsel, Geldanweisungen oder andere Zahlungsmittel, Guthaben, Schulden und Schuldverpflichtungen, Wertpapiere und Schuldtitel, Wertpapierzertifikate, Obligationen, Schuldscheine, Optionsscheine, Pfandbriefe, Derivate; Zinserträge, Dividenden oder andere Einkünfte oder Wertzuwächse aus Vermögenswerten; Kredite, Rechte auf Verrechnung, Bürgschaften, Vertragserfüllungsgarantien oder andere finanzielle Zusagen; Akkreditive, Konnossemente, Sicherungsübereignungen, Dokumente zur Verbriefung von Anteilen an Fondsvermögen oder anderen Finanzressourcen und jedes andere Finanzierungsinstrument für Exporte;
Sperrung von Geldern: die Verhinderung jeder Handlung, welche die Verwaltung oder die Nutzung der Gelder ermöglicht, mit Ausnahme von normalen Verwaltungshandlungen von Finanzinstituten;
wirtschaftliche Ressourcen: Vermögenswerte jeder Art, unabhängig davon, ob sie materiell oder immateriell, beweglich oder unbeweglich sind, insbesondere Immobilien und Luxusgüter, mit Ausnahme von Geldern nach Buchstabe a;
Sperrung wirtschaftlicher Ressourcen: die Verhinderung ihrer Verwendung zum Erwerb von Geldern, Waren oder Dienstleistungen, einschliesslich des Verkaufs, des Vermietens oder des Verpfändens solcher Ressourcen.
Art. 3a8 Verbot der Erfüllung bestimmter Forderungen
Es ist verboten, Forderungen der folgenden Personen, Unternehmen und Organisationen zu erfüllen, wenn sie auf einen Vertrag oder ein Geschäft zurückzuführen sind, dessen Durchführung direkt oder indirekt durch Massnahmen verhindert oder beeinträchtigt wurde, die vom UNO-Sicherheitsrat im Rahmen der Resolutionen 1737 (2006), 1747 (2007) und 1803 (2008) beschlossen wurden:
die Regierung der Islamischen Republik Iran;
natürliche Personen, Unternehmen und Organisationen in der Islamischen Republik Iran;
natürliche Personen, Unternehmen und Organisationen nach den Anhängen3 und 4;
natürliche Personen, Unternehmen und Organisationen, die im Auftrag oder zugunsten einer unter den Buchstaben a–c erwähnten Person, Unternehmung oder Organisation handeln.
Art. 3b9 Ein- und Durchreiseverbot
Die Einreise in die Schweiz oder die Durchreise durch die Schweiz ist den in Anhang 4 aufgeführten natürlichen Personen verboten.
Das Bundesamt für Migration (BFM) kann in Übereinstimmung mit den Beschlüssen des zuständigen Komitees des UNO-Sicherheitsrates Ausnahmen gewähren.
2. Abschnitt Vollzug und Strafbestimmungen
Art. 4 Kontrolle und Vollzug
Das SECO überwacht den Vollzug der Zwangsmassnahmen nach den Artikeln1, 1a, 2 und 3a. Es meldet dem zuständigen Komitee des UNO-Sicherheitsrates und der Internationalen Atomenergieorganisation die Lieferung von Gütern, einschliesslich Technologien und Software, in Übereinstimmung mit den Resolutionen 1737 (2006) und 1803 (2008).10

Das EDA unterrichtet das zuständige Komitee des UNO-Sicherheitsrates, wenn natürliche Personen nach Anhang 3 in die Schweiz einreisen oder durch die Schweiz durchreisen.
Das BFM erlässt die zum Vollzug von Absatz 2 erforderlichen Weisungen an die Grenzkontrollorgane, die Auslandvertretungen und die anderen im Ausland zur Visumausstellung ermächtigten Stellen.12
Die Kontrolle an der Grenze obliegt der Eidgenössischen Zollverwaltung.
Die zuständigen Behörden ergreifen auf Anweisung des SECO die für die Sperrung wirtschaftlicher Ressourcen notwendigen Massnahmen, zum Beispiel die Anmerkung einer Verfügungssperre im Grundbuch oder die Pfändung oder Versiegelung von Luxusgütern.
Art. 5 Meldepflichten
Personen und Institutionen, die Gelder halten oder verwalten oder von wirtschaftlichen Ressourcen wissen, von denen anzunehmen ist, dass sie unter die Sperrung nach Artikel 2 Absatz 1 fallen, müssen dies dem SECO unverzüglich melden.
Personen und Institutionen, die Gelder oder wirtschaftliche Ressourcen von Unternehmen nach Anhang 5 halten oder verwalten, müssen dies dem SECO unverzüglich melden.13
Die Meldungen müssen die Namen der Begünstigten sowie Gegenstand und Wert der Gelder und wirtschaftlichen Ressourcen enthalten.14
Art. 6 Strafbestimmungen
Wer gegen Artikel 1, 1a, 2, 3a oder 3b verstösst, wird nach Artikel 9 EmbG bestraft.15
Wer gegen Artikel 5 verstösst, wird nach Artikel 10 EmbG bestraft.
Verstösse nach den Artikeln9 und 10 EmbG werden vom SECO verfolgt und beurteilt; dieses kann Beschlagnahmungen oder Einziehungen anordnen.
