Accused person

The person suspected, investigated or charged with an offence, enjoying defence rights and procedural protections throughout the case.

Under Swiss criminal procedure, a person becomes an accused person once suspected of an offence in proceedings directed against them. The status carries important rights: to be informed of the accusation, remain silent, appoint or receive defence counsel where required, participate in key procedural acts, and challenge decisions. The accused is presumed innocent until a final conviction and may not be compelled to incriminate themselves. Duties such as appearing when summoned may still apply.
