Administrative appeal

An administrative appeal is a legal remedy by which an affected person asks a higher administrative or judicial authority to review a decision.

Administrative appeals are central to Swiss public-law protection. The available remedy, deadline, standing and reviewing authority depend on federal or cantonal procedural law and on the subject matter. An appeal may challenge legal errors, incorrect facts and, where the law permits, inappropriate exercise of discretion. Filing an appeal does not always suspend enforcement; suspensive effect may be granted, excluded or withdrawn. A successful appeal may lead to annulment, amendment, remittal to the authority, or sometimes a new decision by the appeal body.
