Administrative detention
Administrative detention in migration law allows temporary custody of a foreign national to secure removal, transfer, or identity clarification under strict safeguards.
Swiss migration authorities may order administrative detention for defined purposes such as preparing a removal, ensuring execution of removal, securing a Dublin transfer, or clarifying identity in limited situations. It is not a criminal penalty and must be based on law, necessary, proportionate, and time-limited. Judicial review is central because detention affects personal liberty. Vulnerability, family unity, health, and the best interests of children are important limits. Release must follow if removal or transfer is no longer realistically enforceable.
