Amendment of claim
In Swiss civil litigation, a claimant may under certain conditions amend the relief sought or the factual basis of the action. The possibility depends on timing, connection with the original claim, jurisdictional competence and whether the applicable procedure allows the modification. Amendments must not unfairly surprise the opposing party or undermine orderly conduct of the case. They may affect court fees, party compensation and evidence. In later stages or on appeal, amendments are usually more restricted than at the beginning of the proceedings.
