Animal owner liability concerns damage caused by animals and usually turns on control, custody and proof of due care under Swiss law.
Animal owner liability allocates the risk that an animal causes injury or property damage. In Swiss law, the responsible person is typically the keeper or custodian, not necessarily the formal owner, because liability follows actual control. The keeper may avoid liability by proving that the required care in custody and supervision was exercised, or that the damage would have occurred despite such care. Assessment depends on the species, temperament, situation, foreseeability and precautions taken.
