Appeal

Procedure asking a higher authority to review a decision for legal or factual errors, with scope and remedies depending on the case type.

An appeal is a procedural remedy by which a party seeks review of a decision by a higher court or authority. In Switzerland, the available remedy, time limit, permissible grounds and standard of review depend on the field of law and the level of the deciding body. Some appeals allow review of facts and law; others are limited mainly to legal issues or arbitrariness. Filing an appeal does not always suspend enforcement. The appellate body may confirm, amend, annul or remit the decision, depending on the governing procedure.
