Arbitration
Arbitration is a private dispute-resolution process in which parties submit a dispute to arbitrators whose award is normally binding and enforceable.
In Switzerland, arbitration is important for both domestic and international commercial disputes, including finance, trade, construction and sports matters. It rests on party agreement, usually an arbitration clause or separate submission agreement. The parties may shape the procedure, choose arbitrators and select language and seat, while mandatory guarantees such as independence, impartiality and the right to be heard remain relevant. Arbitral awards are generally final, with limited court review and broad cross-border enforceability under international instruments.
