Authorization to proceed
An authorization to proceed permits the claimant to file a civil action after an unsuccessful Swiss conciliation attempt.
In Swiss civil procedure, an authorization to proceed is issued by the conciliation authority when conciliation fails and the matter is not otherwise resolved. It enables the claimant to bring the claim before the competent court within the applicable time limit. The document usually identifies the parties, the dispute and the claims, and it is an important procedural prerequisite where conciliation is mandatory. If the claimant does not act in time, the authorization may lapse and a new conciliation step may be needed.
