Checks and balances

Checks and balances are institutional controls through which state bodies limit, supervise or counterweight one another’s powers.

Checks and balances complement separation of powers by giving institutions legal means to control or influence each other. They may include parliamentary oversight of government, judicial protection against unlawful action, budgetary powers, appointment procedures, referendums, initiatives, federal participation and transparency duties. In Switzerland, checks are shaped by direct democracy, a collegial executive, bicameralism, cantonal involvement and judicial review within defined limits. The concept does not require constant institutional conflict; it seeks accountable cooperation. Effective checks reduce the risk of arbitrary power, protect minorities and maintain public trust. Comparative constitutional systems differ in the intensity and form of these mechanisms, especially regarding constitutional courts and presidential veto powers.
