Default judgment
A judgment entered against a party, usually the defendant, because it failed to appear, respond, or take required procedural steps.
A default judgment is a decision entered when a party does not participate as required, typically by failing to answer a complaint or attend a hearing. Common-law systems may allow judgment based on default if procedural safeguards are met. Swiss civil procedure also contains consequences for non-appearance or failure to act, but the court may still examine certain procedural requirements and, depending on the case, the basis of the claim. Proper service and the opportunity to be heard are central safeguards.
