Definitive dismissal of objection
Definitive dismissal of objection removes an objection when the creditor relies on an enforceable judgment or equivalent enforceable title.
Definitive dismissal of objection is a summary enforcement step in Switzerland. It is granted where the creditor presents an enforceable judgment, court settlement, arbitral award, administrative decision or comparable title that establishes the debt. The court does not re-litigate the merits; it verifies whether the title is enforceable and covers the claim pursued. If granted, the creditor may continue the debt enforcement. The debtor’s objections are limited, for example to payment, postponement, limitation or defects affecting enforceability, depending on the title and circumstances.
