Effective remedy
A legal avenue capable of addressing an alleged rights violation through independent review and appropriate relief in practice.
An effective remedy is more than a formal right to complain. It must offer a realistic possibility to have an alleged violation examined by a competent and sufficiently independent body, with powers to prevent, end or redress the harm. In Swiss law this idea informs appeal rights, judicial review of administrative action and procedural guarantees. Effectiveness depends on timeliness, scope of review, suspensive effect where needed, access to files and reasons, and the availability of meaningful relief. The remedy need not always succeed, but it must be capable of providing protection in practice.
