Enforcement clause
An enforcement clause is a formal certification that an instrument may be used for compulsory enforcement under the applicable rules.
An enforcement clause, in systems that require it, confirms that a judgment or deed is enforceable and may be used by enforcement authorities. Swiss law does not always use the same terminology, but comparable functions arise when an authority certifies enforceability or issues an enforceable copy. The clause does not create the underlying claim; it records that procedural conditions for enforcement are met. Cross-border matters may require separate recognition or declarations of enforceability.
