Federal Supreme Court standing

The party’s entitlement to appeal to the Federal Supreme Court, based on participation, personal affectation and a protected interest.

Standing before the Swiss Federal Supreme Court determines who may file an appeal. The requirements vary by remedy and field, but generally demand that the appellant took part in the previous proceedings or was prevented from doing so, is specially affected by the decision, and has a current practical or legally protected interest in its alteration. In constitutional complaints, the legally protected interest is particularly important. Standing is examined separately from the merits: a legally interesting argument is not enough if the appellant is not entitled to bring it.
