Fraud

Fraud is intentional deception inducing a party to enter a contract, giving the deceived party remedies such as avoidance.

Fraud in obligations law means deliberate deception that causes another person to conclude a contract or make a legal declaration. It may consist of false statements, concealment where there is a duty to disclose, or manipulative conduct. In Swiss law, fraud can make the contract challengeable even where the error induced is not otherwise essential. The deceived party must act within the applicable time limits and may also claim damages if the requirements are met. Fraud is distinct from mere negotiation exaggeration and from negligent misinformation.
