Marriage contract

A marriage contract lets spouses choose or modify their matrimonial property regime within the limits of mandatory family law.

A marriage contract is an agreement between spouses or future spouses concerning their matrimonial property regime. In Switzerland it may select or adapt recognised regimes, such as participation in acquisitions, separation of property, or community of property, within statutory limits. It does not freely determine child-related matters, divorce itself, or duties that mandatory law reserves to courts. Formal requirements are important, typically involving public authentication. A well-drafted contract clarifies ownership, debt responsibility, and consequences of death or divorce, while respecting protection of each spouse and third parties.
