A matrimonial property regime determines how spouses’ assets and debts are owned, managed, and divided during marriage and at its end.

In Swiss family law, the matrimonial property regime governs the financial relationship between spouses. It determines ownership, management, liability for debts, and liquidation when the marriage ends through divorce, death, or a change of regime. The ordinary statutory regime is participation in acquired property unless spouses validly choose another regime by marital agreement. Separation of property and community of property are the main alternatives. The regime is distinct from maintenance, inheritance, and pension splitting, though these areas often interact in practice.
