Mineral rights
Mineral rights determine who may explore for and extract subsurface resources, and under what property, concession, environmental and planning constraints.
Mineral rights allocate legal control over minerals below the surface and set conditions for exploration, extraction and royalties or fees. In Switzerland, ownership and regulatory authority over subsurface resources are largely shaped by cantonal law, within federal constraints on environment, spatial planning, water, nature protection and worker safety. Projects normally require permits or concessions and environmental assessment where impacts are significant. Comparative differences are substantial: some systems vest minerals in landowners, others in the state, and rules vary for strategic minerals, geothermal resources and community participation.
