Motor vehicle liability

Liability of vehicle keepers and users for damage caused by the operation of a motor vehicle, often governed by special strict-liability rules.

In Swiss law, motor vehicle liability is a special form of extra-contractual liability linked to the risks of road traffic. The vehicle keeper may be liable for personal injury and property damage caused by the vehicle’s operation even without personal fault, subject to statutory defences and possible reduction for the injured party’s conduct. Insurance plays a central role because liability cover is mandatory for many vehicles. Fault remains relevant for recourse, contributory negligence and some claims between participants.
