Party compensation

Party compensation is the amount awarded to reimburse the successful party for recoverable legal costs and necessary expenses.

Party compensation in Swiss civil litigation refers to the indemnity one party must pay another for attorney’s fees and other necessary expenses, usually following the outcome of the case. It is separate from court costs owed to the state. The amount is generally determined by cantonal tariffs or procedural rules and may not fully match the actual fees charged by counsel. Courts may apportion compensation where success is partial, where conduct increased costs, or where special circumstances justify a different allocation.
