Personality rights

Personality rights protect a person’s physical, psychological, social and economic identity against unlawful interference by others or the state.

In Swiss private law, personality rights safeguard dignity, bodily integrity, privacy, honour, name, image, reputation and aspects of personal autonomy. They bind private persons and complement constitutional fundamental rights, which primarily constrain public authorities. An infringement may be justified by consent, overriding private or public interests, or law; otherwise remedies may include injunctions, removal, declaratory relief, damages or satisfaction. The concept is important in media, employment, medical treatment, data protection and digital communications.
