Platform liability concerns when online intermediaries are responsible for user content, transactions, illegal goods, data processing or harmful conduct.
Swiss law does not rely on a single comprehensive platform-liability code. Responsibility depends on the platform’s role, knowledge, control over content or transactions, contractual commitments and sector-specific duties. Issues include defamation, intellectual property, consumer protection, illegal products, competition law, data protection and financial or mobility services. Notice-and-takedown practices, moderation terms and transparent procedures reduce risk but must respect users’ rights and evidence needs.
