Private claimant
An injured person who participates in criminal proceedings to pursue prosecution rights, civil claims, or both against the accused.
In Swiss procedure, a person directly harmed by an alleged offence may constitute themselves as a private claimant. This status allows participation in the criminal case, for example by requesting evidence, challenging certain decisions, and asserting civil claims such as damages or satisfaction. The private claimant may act on the criminal aspect, the civil aspect, or both. The role is distinct from the public prosecutor and may involve cost risks if claims or procedural requests fail.
