Product liability

Product liability concerns harm caused by products that are unsafe or defective when put into circulation. Swiss law has a specific product liability regime influenced by European models, alongside general contract, tort and warranty rules. A claimant usually examines whether the item is a product, whether it had a defect in safety, whether damage occurred, and whether the defect caused that damage. Liability may attach to manufacturers, importers or others treated as producers, subject to statutory defences and limitation rules. Product liability is distinct from mere dissatisfaction with quality: it focuses on safety risks causing personal injury or property damage. Regulatory duties, recalls and consumer protection may also be relevant.
