Provisional release
Provisional release is the discharge of an accused person from pre-trial detention, often subject to conditions securing the proceedings.
In Swiss criminal procedure, provisional release concerns a person held in pre-trial or security detention who is freed before the case is finally resolved. Release may be unconditional or linked to substitute measures, such as reporting duties, travel restrictions, bail, contact bans, or electronic monitoring. The decisive issue is whether grounds for detention, such as risk of flight, collusion, reoffending, or serious danger, still justify deprivation of liberty. Courts must also respect proportionality and review detention promptly.
