Restitution

The legal reversal of a transfer or benefit, usually by returning what was received or its value to the entitled person.

Restitution is the remedy that restores a benefit to the person entitled to it. In Swiss private law it appears in several contexts: unjust enrichment, unwinding invalid or rescinded contracts, return of property, or accounting for benefits obtained through another’s affairs. Restitution may be in kind, where the exact object can be returned, or by payment of its value. It differs from damages because its focus is the benefit received, not necessarily the claimant’s full loss.
