Revocation of administrative decision

Withdrawal or alteration of an administrative decision by the authority, balancing legality, public interest and legitimate expectations.

Revocation means that an administrative authority withdraws or changes a decision, often with effect for the future and sometimes retroactively. Swiss law balances correction of unlawful or unsuitable decisions against legal certainty and the protection of legitimate expectations. The result depends on factors such as whether the decision conferred rights, whether the recipient relied on it in good faith, and the weight of the public interest. Special statutes may define stricter rules for particular permits, benefits or concessions.
