Suspended sentence
A suspended sentence is a penalty whose execution is deferred if the offender complies with conditions during a probationary period.
Under Swiss criminal law, a suspended sentence allows the court to pronounce a penalty but postpone its execution because the offender’s prognosis is sufficiently favourable. The person must avoid reoffending during a probationary period and may have to comply with instructions or probation assistance. If the conditions are respected, the sentence is not served; if they are breached, execution may be ordered. Suspension is distinct from acquittal: guilt and the sentence remain established.
