Termination protection in tenancy law limits or reviews lease notices to prevent abusive termination and may allow extensions in hardship cases.
Swiss tenancy law gives tenants important protection against termination of residential and commercial leases. A notice may be challenged if it is contrary to good faith or abusive, for example when used to pressure the tenant or retaliate against legitimate claims. Tenants may also seek an extension of the lease where termination would cause hardship not justified by the landlord’s interests. Special forms, deadlines and conciliation procedures are central. Protection does not make leases perpetual; valid landlord interests and statutory grounds remain relevant.
