A procedural guarantee requiring authorities and courts to handle matters within a reasonable time, considering complexity and stakes.
Timely justice requires proceedings to move without unjustified delay. In Switzerland the reasonableness of duration is assessed in light of the case’s complexity, the parties’ conduct, the authority’s diligence and the importance of the matter for those affected. Delay may occur through inactivity, repeated remittals or excessive scheduling. Remedies can include complaints for delay, orders to act, consideration in costs or, in criminal cases, consequences for sentencing or procedure. Speed must remain compatible with careful fact-finding and the right to be heard.
