Trademark

A trademark protects signs that distinguish goods or services, such as words, logos, shapes, colours or other distinctive identifiers.

Swiss trademark law protects signs capable of distinguishing one undertaking’s goods or services from those of others. Registration is usually required and gives the owner exclusive rights for specified goods and services, subject to renewal and use requirements. Marks lacking distinctiveness, misleading signs and certain protected symbols may be refused. Trademark rights support branding, licensing, franchising and enforcement against confusion, dilution or counterfeiting. International registration systems are important because brand protection is territorial, and businesses often need coordinated Swiss, EU and global strategies.
