Warranty for defects

In Swiss law, warranty for defects is especially important in sales and work contracts. It addresses hidden or apparent defects that reduce value or suitability, or depart from promised qualities. The entitled party generally must inspect and notify defects in time; failure may lead to acceptance of the performance. Remedies vary by contract type and agreement, but commonly include rescission, price reduction, repair, replacement and, in some situations, damages. Contractual exclusions or limitations may be valid but are restricted where defects are fraudulently concealed.
