Wrongful termination

In Swiss private employment law, the closer concept is often abusive termination or termination at an unlawful time. A dismissal may be abusive if motivated by prohibited reasons, retaliation, exercise of constitutional or contractual rights, or bad-faith conduct. Termination during protected periods, such as certain illness, accident, pregnancy, or service situations, may be invalid or postponed. Remedies commonly focus on compensation rather than reinstatement, although special regimes may differ. Employees must observe short procedural steps and deadlines to preserve claims.
