über Massnahmen gegenüber der Islamischen
Republik Iran
Änderung vom 23. April 2008
Der Schweizerische Bundesrat
verordnet:
I
Die Verordnung vom 14. Februar 20071 über Massnahmen gegenüber der Islamischen Republik Iran wird wie folgt geändert:
Ingress gestützt auf Artikel 2 des Embargogesetzes vom 22. März 20022 (EmbG), in Ausführung der Resolutionen 1737 (2006), 1747 (2007) und 1803 (2008)3 des Sicherheitsrates der Vereinten Nationen,
Art. 1a Verbot der Beschaffung von Rüstungsgütern und verwandtem Material
Die Beschaffung, die Einfuhr, die Durchfuhr und die Vermittlung von Rüstungsgütern jeder Art, einschliesslich Waffen und Munition, Militärfahrzeuge und -ausrüstung, paramilitärische Ausrüstung sowie Zubehör und Ersatzteile dafür, aus der Islamischen Republik Iran sind verboten.
Art. 3a Verbot der Erfüllung bestimmter Forderungen
Es ist verboten, Forderungen der folgenden Personen, Unternehmen und Organisationen zu erfüllen, wenn sie auf einen Vertrag oder ein Geschäft zurückzuführen sind, dessen Durchführung direkt oder indirekt durch Massnahmen verhindert oder beeinträchtigt wurde, die vom UNO-Sicherheitsrat im Rahmen der Resolutionen 1737 (2006), 1747 (2007) und 1803 (2008) beschlossen wurden:
die Regierung der Islamischen Republik Iran;
natürliche Personen, Unternehmen und Organisationen in der Islamischen Republik Iran;
natürliche Personen, Unternehmen und Organisationen nach den Anhängen 3 und 4;
d. natürliche Personen, Unternehmen und Organisationen, die im Auftrag oder zugunsten einer unter den Buchstaben a–c erwähnten Person, Unternehmung oder Organisation handeln.
Art. 3b Ein- und Durchreiseverbot
Die Einreise in die Schweiz oder die Durchreise durch die Schweiz ist den in Anhang 4 aufgeführten natürlichen Personen verboten.
Das Bundesamt für Migration (BFM) kann in Übereinstimmung mit den Beschlüssen des zuständigen Komitees des UNO-Sicherheitsrates Ausnahmen gewähren.
Art. 4 Abs. 1, 1bis und 3
Das SECO überwacht den Vollzug der Zwangsmassnahmen nach den Artikeln1, 1a,2 und 3a. Es meldet dem zuständigen Komitee des UNO-Sicherheitsrates und der Internationalen Atomenergieorganisation die Lieferung von Gütern, einschliesslich Technologien und Software, in Übereinstimmung mit den Resolutionen 1737 (2006) und 1803 (2008).

Das BFM erlässt die zum Vollzug von Absatz 2 erforderlichen Weisungen an die Grenzkontrollorgane, die Auslandvertretungen und die anderen im Ausland zur Visumausstellung ermächtigten Stellen.
Art. 6 Abs. 1
Wer gegen Artikel 1, 1a,2, 3a oder 3b verstösst, wird nach Artikel 9 EmbG bestraft.
II
Die Anhänge1 und 3 erhalten die neue Fassung gemäss Beilage.
III
Diese Verordnung erhält einen zusätzlichen Anhang 4 gemäss Beilage.
IV
Diese Änderung tritt am 24. April 20084 in Kraft.

Anhang 1
(Art. 1 Abs. 1) Güter, einschliesslich Technologien und Software, die unter das Verbot nach Artikel 1 Absatz 1 fallen 1. Güter nach Anhang 2 Teil 1 GKV5. Ausgenommen sind Güter der Exportkontrollnummer 0A001, sofern sie ausschliesslich für Leichtwasserreaktoren bestimmt sind. 2. Kernmaterialien nach Artikel 1 der Kernenergieverordnung vom 10. Dezember 20046 (KEV). Ausgenommen ist niedrig angereichertes Uran in fertiggestellten Brennelementen für Leichtwasserreaktoren. 3. Vollständige Raketen- und unbemannte Luftfahrzeugsysteme einschliesslich vollständiger Subsysteme hierfür. 4. Güter nach Anhang 2 Teil 2 GKV mit den Kontrollregime-Codes 101–199. 5. Güter nach Anhang 2 Teil 2 GKV mit den Kontrollregime-Codes 201–299. Ausgenommen sind solche Güter, sofern sie ausschliesslich für Leichtwasserreaktoren bestimmt oder für die technische Zusammenarbeit notwendig sind, die der Islamischen Republik Iran von der Internationalen Atomenergieorganisation gewährt wird. 6. Alle übrigen Güter, die im Zusammenhang mit Raketen- und unbemannten Luftfahrzeugsystemen nach Ziffer 3 verwendet werden können und die von Anhang 2 Teil 2 GKV, Anhang 3 GKV oder Anhang 1 der Kriegsmaterialverordnung vom 25. Februar 19987 (KMV) erfasst werden.
