Sie haben uns in Nachachtung von Art. 31 des Baugesetzes (sGS 731.1; abgekürzt BauG) fol­ genden Erlass zur Genehmigung eingereicht: •

Überbauungsplan Hinterdorf

Beim Planungsgebiet im Hinterdorf handelt es sich um den noch erhaltenen Teil des ehemals das ganze Dorf umgebenden Grünraums (Bummert), sowie die angrenzende Überbauung an der Hinterdorfstrasse, der Oberdorfstrasse sowie der Ifangstrasse. Die Planung stellt in verschiedener Hinsicht eine besondere Herausforderung dar: Das in der Kernzone K2, in der OeBA und in der Wohnzone W2 gelegene Areal liegt zu einem wesentlichen Teil im Bereich des Ortsbildschutzgebietes. Es gilt sicherzustellen, dass die kleinmassstäbliche und Identität bildende Überbauungsstruktur v.a. entlang der Hinterdorfstrasse und der Oberdorfstrasse nicht zerstört wird. Mit der älteren Bausubstanz ist sorgfältig umzugehen, ebenso sorgfältig sind auch Neubauten in die gewachsenen Strukturen einzufügen. Anspruchsvoll und jahrelang umstritten war wegen der fast lückenlosen Überbauung entlang der Strassen auch die Erschliessung des Gebiets. Das mit dem Überbauungsplan Hinterdorf sichergestellte Erschliessungs- und Überbauungs­ konzept ist das Resultat eines beispielhaften Planungsprozesses. Es gelang, verschiedene Interessen und Ansprüche in einem ausgewogenen Konzept zu bündeln (Ortsgestaltung/Denk­ malpflege, Erschliessung, haushälterische und wirtschaftliche Bodennutzung, etc.) und auch die Zustimmung der Anwohner zu erreichen. Die Prüfung ergibt, dass der Erlass recht- und zweckmässig ist und genehmigt werden kann.

In Anwendung von Art. 31 BauG und Art. 94 Abs. 1 des Gesetzes über die Verwaltungsrechts­ pflege (sGS 951.1; abgekürzt VHP), Art. 1 Abs. 1 in Verbindung mit Anhang 6 der Ermächti­ gungsverordnung (sGS 141.41) sowie dem Gebührentarif für die Staats- und Gemeindever­ waltung (sGS 821.5) verfügt das Baudepartement: 1. Der angeführte Erlass wird genehmigt. 2. Die Gebühr für diese Verfügung beträgt Fr. 1740.-. Aufteilung der Gebühren: Amt für Raumentwicklung Tiefbauamt

Fr. 1'400.-Fr. 340.--

Rechtsmittelbelehrung: Gegen diese Verfügung kann nach Art. 31 Abs. 2 BauG i.V.m. Art. 47 Abs. 1 VHP innert vierzehn Tagen seit Eröffnung Rekurs bei der Regierung erhoben werden.
