Ordinanza che istituisce provvedimenti nei confronti della Liberia

del 19 gennaio 2005 (Stato 1° maggio 2007)

Il Consiglio federale svizzero, visto l’articolo 2 della legge del 22 marzo 20021 sugli embarghi (LEmb); in esecuzione delle risoluzioni 1521 (2003), 1532 (2004), 1579 (2004), 1683 (2006) e 1689 (2006)2 del Consiglio di sicurezza delle Nazioni Unite,3 ordina:

Sezione 1 Misure coercitive

Art. 1 Divieto di fornire materiale d’armamento e materiale affine

Sono vietate la fornitura, la vendita e la mediazione a destinazione della Liberia di materiale d’armamento di ogni genere, comprese armi e munizioni, di veicoli e di equipaggiamento militari, di attrezzature paramilitari nonché dei relativi accessori e pezzi di ricambio.

Sono vietate la fornitura, la vendita e la mediazione di consulenza tecnica, di assistenza o di istruzione connesse con la fornitura, la produzione, la manutenzione e l’utilizzazione del materiale d’armamento di cui al capoverso1 a destinazione della Liberia.

La Segreteria di Stato dell’economia (SECO)4 può, d’intesa con i competenti uffici del Dipartimento federale degli affari esteri (DFAE), accordare deroghe ai divieti di cui ai capoversi1 e 2 per:

  1. l’utilizzazione esclusiva da parte della missione delle Nazioni Unite in Liberia (UNMIL);

  2. 5 l’utilizzazione esclusiva da parte delle forze di sicurezza e di polizia del governo liberiano, controllate e formate dall’inizio del mandato della MINUL nell’ottobre del 2003;

  3. la fornitura di materiale militare non letale esclusivamente destinato a scopi umanitari o di protezione;

La designazione dell’unità amministrativa è stata adattata in applicazione dell’art. 16 cpv. 3 dell’O del 17 nov. 2004 sulle pubblicazioni ufficiali (RS 170.512.1). Di detta modifica è stato tenuto conto in tutto il presente testo.

d. la fornitura di indumenti di protezione (ad es. giubbotti antiproiettile) destinati all’utilizzazione individuale da parte del personale delle Nazioni Unite, di rappresentanti dei media e del personale umanitario.

Sono fatte salve le disposizioni della legge del 13 dicembre 19966 sul controllo dei beni a duplice impiego e della legge del 13 dicembre 19967 sul materiale bellico.

Blocco degli averi e delle risorse economiche

Gli averi e le risorse economiche di proprietà o sotto il controllo delle persone fisiche, delle imprese e delle organizzazioni menzionate nell’allegato1 sono bloccati.

È vietato trasferire averi alle persone fisiche, alle imprese e alle organizzazioni che sottostanno al blocco, oppure mettere a loro disposizione, direttamente o indirettamente, averi e risorse economiche.

D’intesa con gli uffici competenti del DFAE e del Dipartimento federale delle finanze, la SECO può eccezionalmente autorizzare prelievi da conti bloccati, trasferimenti di valori patrimoniali bloccati, nonché la liberazione delle risorse economiche bloccate per tutelare interessi svizzeri o per prevenire casi di rigore.

Definizioni Nella presente ordinanza si intende per:

a. averi: valori patrimoniali, compresi denaro contante, assegni, crediti monetari, cambiali, ordini o altri strumenti di pagamento, depositi, debiti e riconoscimenti di debito, cartevalori e titoli di debito, certificati azionari, obbligazioni, titoli di credito, opzioni, obbligazioni fondiarie, derivati; interessi, dividendi o altri redditi o plusvalori generati da valori patrimoniali; crediti, diritti a compensazione, garanzie, fideiussioni o altri impegni finanziari; accrediti, polizze di carico, contratti di assicurazione, documenti di titolarizzazione di quote di fondi o altre risorse finanziarie e qualsiasi altro strumento di finanziamento delle esportazioni;

  1. blocco degli averi: l’impedimento di ogni atto che permetta la gestione o l’utilizzazione degli averi, fatte salve le normali operazioni amministrative effettuate dagli istituti finanziari;

  2. risorse economiche: i valori patrimoniali di ogni genere, indipendentemente dal fatto che siano materiali o immateriali, mobili o immobili, in particolare gli immobili e i beni di lusso, fatti salvi gli averi di cui alla lettera a;

  3. blocco delle risorse economiche: l’impedimento dell’impiego di tali risorse per acquisire averi, merci o servizi, comprese la vendita, la locazione o la costituzione in pegno delle risorse medesime.

Art. 48 Divieto di importazione e di transito di diamanti grezzi

Sono vietati l’importazione e il transito, nonché il magazzinaggio in depositi doganali aperti, in depositi di merci di gran consumo e in depositi franchi doganali o l’uscita da depositi doganali aperti, da depositi di merci di gran consumo e da depositi franchi doganali di diamanti grezzi provenienti direttamente o indirettamente dalla Liberia, a prescindere dal loro Paese d’origine.

Art. 59

Art. 6 Divieto di entrata e di transito

L’entrata in Svizzera o il transito attraverso la Svizzera sono vietati alle persone fisiche elencate nell’allegato 2.

L’Ufficio federale della migrazione può concedere deroghe in conformità alle decisioni del competente comitato del Consiglio di sicurezza delle Nazioni Unite oppure per tutelare interessi svizzeri.

Sezione 2 Esecuzione e disposizioni penali

Art. 7 Controllo ed esecuzione

La SECO sorveglia l’esecuzione delle misure coercitive di cui agli articoli1, 2 e 4.10

L’Ufficio federale della migrazione sorveglia l’esecuzione del divieto di entrata e di transito di cui all’articolo6.

Il controllo al confine è di competenza dell’Amministrazione federale delle dogane.

Su indicazione della SECO, le autorità competenti adottano i provvedimenti necessari al blocco delle risorse economiche, ad esempio la menzione nel registro fondiario di un divieto di disporre dei beni, oppure il pignoramento o il suggellamento di beni di lusso.

Art. 8 Dichiarazioni obbligatorie

Le persone e le istituzioni che detengono o amministrano averi, oppure sono a conoscenza di risorse economiche, presumibilmente rientranti nel campo d’applicazione del blocco di cui all’articolo 2 capoverso1, li dichiarano senza indugio alla SECO.

Le dichiarazioni indicano i nomi dei beneficiari, l’oggetto e il valore degli averi e delle risorse economiche bloccati.

Art. 9 Disposizioni penali

Chiunque viola gli articoli1, 2, 4 o 6 della presente ordinanza è punito conformemente all’articolo 9 LEmb.11

Chiunque viola l’articolo 8 della presente ordinanza è punito conformemente all’articolo 10 LEmb.

Le infrazioni di cui agli articoli9 e 10 LEmb sono perseguite e giudicate dalla SECO; esso può ordinare sequestri e confische.

Sezione 3 Disposizioni finali

Art. 10 Diritto previgente: abrogazione

L’ordinanza del 27 giugno 200112 che istituisce provvedimenti nei confronti della Liberia è abrogata.

Art. 11 Entrata in vigore

La presente ordinanza entra in vigore il 20 gennaio 2005.

946.231.16 Commercio con l’estero The Director of this firm is Baba Jobe. Its one aircraft, a Russian-made passenger jet, was acquired from Centrafrican Airlines. Richard Chichakli, who is Viktor Richardson, Texas 75080, USA Bout’s Chief Financial Officer, is listed as the President of the company. The company is located at the same address in Richardson, Texas as Richard Chichakli’s accounting firm. Irbis was formed in 1998 and leases its Almaty, Khazakhstan 48004 aircraft exclusively from Air Cess. The «UN Final Report of the Monitoring Mechanism on Angola Sanctions» in 2000 reported «it can be considered that Irbis forms an Eastern European office for Viktor Bout.» Press reports further indicated that the company is owned by Viktor Bout. This company is owned and managed Moldova by an admitted employee of Viktor Bout who is a longtime former agent of Air Cess. Moldtransavia’s only plane is owned by Viktor Bout and is insured by a Viktor Bout company, San Air General Trading. As such, Moldstransavia is indirectly controlled by Viktor Bout.

It was formerly known as Okapi Air and was non-operational when Viktor Bout purchased it. An Ugandan judicial commission noted that Odessa Air is one of several aviation firms that Viktor Bout registered in Uganda and the Civil Aviation Authority. Texas State corporate records show Richardson, Texas 75080, USA Richard Chichakli, Viktor Bout’s Chief Financial Officer, as the sole director of this firm. Richard Chichakli identified himself in a 2004 filling as the firm’s president. The company is located at the same address in Richardson, Texas as Richard Chichakli’s accounting firm. 946.231.16 Commercio con l’estero According to a local corporate Bulgaria 1113 registry, Sergei Bout is the sole owner and CEO of Rockman, Ltd., incorporated in Bulgaria. According to a commercial database report, Sergei Bout holds 100 % of the voting capital of the company. San Air General Trading serves as an P.O. Box 2190, Ajman, UAE agent for Centrafrican Airlines, a company owned by Viktor Bout. UN 811 S. Central Expressway, Suite 210, investigators concluded that Richardson, Texas 75080, USA Centrafrican Airlines and San Air are, in fact, parts of the same company. The General Manager of San Air is Serguei Denissenko. In addition, the UN has identified Richard Chichakli as the Chief Financial Officer for San Air General Trading in the UAE, and Richard Chichakli has admitted in media interviews that he «set (San Air) up for Viktor (Bout).» As such, San Air is owned by Viktor Bout and controlled by Viktor Bout, Serguei Denissenko and Richard Chichakli.
