Accord agricole entre la Suisse et les Etats membres du CCG

Art. 1
1. Le présent Accord concernant le commerce de produits agricoles (ci-après dénommé «le présent Accord») entre la Confédération suisse (ci-après dénommée «la Suisse») et les Gouvernements des Emirats arabes unis, le Royaume de Bahreïn, le Royaume d’Arabie Saoudite, le Sultanat d’Oman, l’Etat du Qatar et l’Etat du Koweït (ci-après dénommés «le CCG»), ci-après dénommé conjointement «les Parties», est conclu en complément à l’Accord de libre-échange entre les Etats membres du CCG et les Etats de l’AELE3 (ci-après dénommé «l’Accord de libreéchange»), qui a été signé le 22 juin 2009, en particulier en vertu de l’art.2.1 dudit Accord. 2. Le présent Accord s’applique également à la Principauté de Liechtenstein aussi longtemps que le traité d’union douanière du 29 mars 1923 entre la Suisse et la Principauté de Liechtenstein4 est en vigueur.
Art. 2
Le CCG octroie des concessions tarifaires pour les produits agricoles originaires de Suisse aux termes de l’Annexe I du présent Accord. La Suisse octroie des concessions tarifaires pour les produits agricoles originaires du CCG conformément à l’Annexe II du présent Accord.
Art. 3
1. Les règles d’origine et les dispositions relatives à la coopération en matière douanière fixées à l’Annexe IV de l’Accord de libre-échange s’appliquent au présent Accord, sous réserve des dispositions contraires de l’al.2. Toute référence aux «Etats de l’AELE» dans cette Annexe est réputée désigner la Suisse. 2. Aux fins du présent Accord, l’art.3 de l’Annexe IV de l’Accord de libre-échange s’applique mutatis mutandis à la Suisse et au CCG.

Art. 4
Les Parties examinent toute difficulté susceptible de surgir dans leurs échanges de produits agricoles et œuvrent à rechercher des solutions appropriées.
Art. 5
Les Parties s’emploient à poursuivre leurs efforts en vue de développer la libéralisation de leurs échanges agricoles dans le cadre de leurs politiques agricoles respectives.
Art. 6
Les Parties confirment les droits et les devoirs prévus par l’Accord sur l’agriculture de l’OMC5, sauf disposition contraire du présent Accord.
Art. 7
1. Les droits et obligations des Parties concernant les mesures sanitaires et phytosanitaires sont régis par l’Accord sur l’application des mesures sanitaires et phytosanitaires de l’OMC6 (ci-après dénommé «l’Accord SPS»). 2. La Suisse et le CCG échangent les noms et adresses des points de contact dotés d’expertise sanitaire et phytosanitaire, afin de faciliter les consultations techniques et l’échange d’informations. 3. Sans préjudice de l’al. 1, les Parties conviennent de conduire des consultations dans le cadre du Comité mixte si l’une des Parties considère qu’une autre Partie a pris des mesures qui pourraient créer ou qui ont créé un obstacle au commerce, afin de trouver une solution appropriée conforme à l’Accord SPS.
Art. 8
Le présent Accord entre en force ou est appliqué provisoirement dès la date à laquelle l’Accord de libre-échange entre en vigueur ou est appliqué provisoirement entre la Suisse et le CCG. Il reste en vigueur aussi longtemps que les Parties contractantes restent Parties à l’Accord de libre-échange.
En foi de quoi les soussignés, dûment autorisés à cet effet, ont signé le présent Accord.
Fait à Hamar, le 22 juin 2009, qui correspond au 29 joumada II de l’an 1430 de l’hégire, en deux exemplaires originaux en anglais. (Suivent les signatures) Annexe I Conditions applicables à l’importation, dans le CCG, de produits originaires de Suisse Les produits originaires de Suisse couverts par la présente Annexe bénéficient de concessions du CCG, selon les catégories suivantes: 1. catégorie A: dès l’entrée en vigueur du présent Accord, le CCG supprime les droits de douane à l’importation des produits figurant dans cette catégorie; 2. catégorie B: cinq ans après l’entrée en vigueur du présent Accord, le CCG supprime les droits de douane à l’importation des produits figurant dans cette catégorie; 3. catégorie C: les droits de douane perçus sur les produits de cette catégorie continuent de s’appliquer. Le CCG informe la Suisse de toute modification du taux appliqué à la nation la plus favorisée; 4. catégorie X: les produits de cette catégorie sont exclus du champ d’application du présent Accord; 5. catégorie P: les produits de cette catégorie sont frappés d’une interdiction d’importation dans le CCG.
