Ordonnance instituant des mesures à l’encontre du Libéria

du 19 janvier 2005 (Etat le 1er mai 2007)

Le Conseil fédéral suisse, vu l’art. 2 de la loi du 22 mars 2002 sur les embargos (LEmb)1, vu les résolutions 1521 (2003), 1532 (2004), 1579 (2004), 1683 (2006) et 1689 (2006)2 du Conseil de sécurité des Nations Unies,3 arrête:

Section 1 Mesures de coercition

Art. 1 Interdiction de fournir des biens d’équipement militaires et du matériel connexe

La fourniture, la vente ainsi que le courtage à destination du Libéria d’armements de toute sorte, y compris d’armes et de munitions, de véhicules et d’équipement militaires, de matériels paramilitaires, de même que leurs accessoires et pièces de rechange, sont interdits.

La fourniture, la vente et le courtage de conseils techniques et de moyens d’assistance ou d’entraînement liés à la fourniture, à la production, à l’entretien et à l’utilisation des biens visés par l’al.1 sont interdits.

Le Secrétariat d’Etat à l’économie (SECO) peut, après consultation des offices compétents du Département fédéral des affaires étrangères (DFAE), autoriser des exceptions aux interdictions prévues aux al. 1 et 2:

  1. pour des fournitures destinées exclusivement à la Mission des Nations Unies au Libéria (MINUL);

  2. 4 pour des fournitures destinées exclusivement aux membres des forces de police et de sécurité du Gouvernement libérien qui ont été contrôlés et formés depuis le début de la MINUL en octobre 2003;

  3. pour la fourniture de matériel militaire non létal destiné exclusivement à un usage humanitaire ou de protection;

d. pour la fourniture de vêtements de protection (p.ex. des gilets pare-balles) pour l’usage du personnel des Nations Unies, des représentants des médias et des agents humanitaires;

Les dispositions de la loi du 13 décembre 1996 sur le contrôle des biens5 et de la loi fédérale du 13 décembre 1996 sur le matériel de guerre6 sont réservées.

Gel des avoirs et des ressources économiques

Les avoirs et les ressources économiques appartenant à ou sous contrôle des personnes, entreprises et entités citées à l’annexe1 sont gelés.

Il est interdit de fournir des avoirs aux personnes, entreprises et entités visées par le gel des avoirs ou de mettre à leur disposition, directement ou indirectement, des avoirs ou des ressources économiques.

Le SECO peut, exceptionnellement, après avoir consulté les offices compétents du DFAE et du Département fédéral des finances, autoriser des versements prélevés sur des comptes bloqués, des transferts de biens en capital gelés et le déblocage de ressources économiques gelées afin de protéger des intérêts suisses ou de prévenir Définitions Au sens de la présente ordonnance, on entend par:

  1. avoirs: tous les actifs financiers, y compris le numéraire, les chèques, les créances monétaires, les lettres de change, les mandats ou autres moyens de paiement, les dépôts, les créances et reconnaissances de dette, les titres et titres de dette, les certificats de titres, les obligations, les titres de créances, les options, les lettres de gage, les dérivés; les recettes d’intérêts, les dividendes ou autres revenus ou plus-values engendrés par des biens en capital; les crédits, les droits à des compensations, les cautions, les garanties d’exécution de contrats ou autres engagements financiers; les accréditifs, les connaissements, les contrats d’assurance, les documents de titrisation de parts à des fonds ou à d’autres ressources financières et tout autre instrument de financement des exportations;

  2. gel des avoirs: le fait d’empêcher toute action permettant la gestion ou l’utilisation des avoirs, à l’exception des actions administratives normales effectuées par des instituts financiers;

  3. ressources économiques: les valeurs de quelque nature que ce soit, corporelles ou incorporelles, mobilières ou immobilières, en particulier les immeubles et les biens de luxe, à l’exception des avoirs au sens de la let. a;

  4. gel des ressources économiques: toute action visant à empêcher leur utilisation afin d’obtenir des avoirs, des biens ou des services de quelque manière que ce soit, y compris par leur vente, leur location ou leur hypothèque.

Art. 47 Interdiction d’importation et de transit de diamants bruts

L’importation, le transit, la mise en entrepôt douanier ouvert, en entrepôt de marchandises de grande consommation ou en dépôt franc sous douane ainsi que la sortie d’un de ceux-ci de diamants bruts provenant directement ou indirectement du Libéria, indépendamment de leur pays d’origine, sont interdits.

Art. 58

Art. 6 Interdiction d’entrée en Suisse et de transit par la Suisse

L’entrée en Suisse et le transit par la Suisse sont interdits aux personnes physiques citées à l’annexe 2.

L’Office fédéral des migrations peut accorder des dérogations en conformité avec les décisions du Comité compétent du Conseil de sécurité des Nations Unies ou si la protection d’intérêts suisses l’exige.

Section 2 Exécution et dispositions pénales

Art. 7 Contrôle et exécution

Le SECO surveille l’exécution des mesures de coercition au sens des art. 1, 2 et 4.9

L’Office fédéral des migrations surveille l’exécution de l’interdiction d’entrée et de transit selon l’art.6.

Le contrôle à la frontière incombe à l’Administration fédérale des douanes.

Sur instruction du SECO, les autorités compétentes prennent les mesures nécessaires pour le gel des ressources économiques, p.ex. la mention d’un blocage du registre foncier ou la saisie ou la mise sous scellé des biens de luxe.

Art. 8 Déclaration obligatoire

Les personnes ou les institutions qui détiennent ou gèrent des avoirs ou qui ont connaissance de ressources économiques dont il faut admettre qu’ils tombent sous le coup du gel selon l’art. 2, al. 1, doivent le déclarer sans délai au SECO.

Sur la déclaration doivent figurer le nom du bénéficiaire, l’objet et la valeur des avoirs et des ressources économiques gelés.

Art. 9 Dispositions pénales

Quiconque viole les dispositions des art. 1, 2,4 ou 6 est puni conformément à l’art. 9 LEmb.10

Quiconque viole les dispositions de l’art. 8 est puni conformément à l’art. 10 LEmb.

Le SECO poursuit et juge les infractions au sens des art. 9 et 10 LEmb; il peut ordonner des saisies ou des confiscations.

Section 3 Dispositions finales

Art. 10 Abrogation du droit en vigueur

L’ordonnance du 27 juin 2001 instituant des mesures à l’encontre du Libéria11 est abrogée.

Art. 11 Entrée en vigueur

La présente ordonnance entre en vigueur le 20 janvier 2005.

According to a local cooperate regis- Bulgaria 1113 try, Sergei Bout is the sole owner and CEO of Nordic, Ltd., incorporated in Bulgaria. According to a commercial database report, Sergei Bout holds 100 % of the voting capital of the company. According to UN reporting, Odessa Air is a Viktor Bout-owned firm based in Uganda. It was formerly known as Okapi Air and was non-operational when Viktor Bout purchased it. An Ugandan judicial commission noted that Odessa Air is one of several aviation firms that Viktor Bout registered in Uganda and the Civil Aviation Authority.

The company is located at the same address in Richardson, Texas as According to a local corporate Bulgaria 1113 registry, Sergei Bout is the sole owner and CEO of Rockman, Ltd., incorporated in Bulgaria. According to a commercial database report, Sergei Bout holds 100 % of the voting capital of the company. San Air General Trading serves as an P.O. Box 2190, Ajman, UAE agent for Centrafrican Airlines, a company owned by Viktor Bout. UN 811 S. Central Expressway, Suite 210, investigators concluded that Richardson, Texas 75080, USA Centrafrican Airlines and San Air are, in fact, parts of the same company. The General Manager of San Air is Serguei Denissenko. In addition, the UN has identified Richard Chichakli as the Chief Financial Officer for San Air General Trading in the UAE, and Richard Chichakli has admitted in media interviews that he «set (San Air) up for Viktor (Bout).» As such, San Air is owned by Viktor Bout and controlled by Viktor Bout, Serguei Denissenko and Richard Chichakli. Santa Cruz Imperial has been identified by various sources as being owned or controlled by Viktor Bout and/or Sanjivan Ruprah. However, there has been some disagreement as to whether Viktor Bout actually owned this company. Nevertheless, Santa Cruz aircraft have operated interchangeably with aircraft from Viktor Bout’s network. Viktor Bout has at least indirect control over Santa Cruz. Southbound, Ltd.

Documents filed when Viktor Bout registered Centrafrican Airlines indicated that Viktor Bout also controlled Southbound. Richard Chichakli is listed as the president and director of this company. The company is located at the same address in Richardson, Texas as Commerce extérieur 946.231.16 Transavia Network is one of Viktor TAN Group Sharjah, UAE Bout’s oldest companies (it first P.O. Box 3962, Sharjah, UAE appeared in Belgium in 1995). Trans Aviation Transavia Travel Agency P.O. Box 2190, Ajman, UAE Transavia Travel Cargo Ostende Airport, Belgium According to a Belgian arrest warrant filed with Interpol in February 2002, Viktor Bout had power of attorney over Vial’s bank accounts. Westbound, Ltd. is owned by Ronald tar, UK De Smet. Ronald De Smet is a Belgian pilot who has a long history of acting on behalf of Viktor Bout. Westbound is a major shareholder in one of Viktor Bout’s companies, Centrafrican Airlines. When Viktor Bout registered Centrafrican Airlines in 1998, the three principal shareholders were Westbound, Southbound, and ATC Ltd., all of Gibraltar. Accordingly, Westbound is indirectly controlled by Viktor Bout.
